TERMS OF SERVICE

Effective Date: January 1, 2026

This document constitutes a legally binding agreement between you (the „User,” „you,” or „your”) and Innovation Lab Sp. z o.o. („Innovation Lab,” „we,” „us,” or „our”) concerning your use of the Innovation Lab’s PARSANKI Mobile Application (the „App” or „Service”).

By creating an account, logging in, or using the Service, you agree to be legally bound by these Terms of Service and our accompanying Privacy Policy.

1. Acceptance of Terms

The act of registering for an account, logging into the App, or using any of its features constitutes your full acceptance of these Terms of Service and the accompanying Privacy Policy. The account creation process explicitly requires your agreement to these terms, as captured by the termsAccepted parameter submitted during registration.

2. Description of the Service

The Innovation Lab’s PARSANKI Mobile Application is a comprehensive mobile tool designed to improve cognitive abilities od users. The Service is intended for use by players, in single or multiplayer mode, to practice and enhance observation skills and memory.

The core functions of the Service include:

  • Memory Improvement Games: You can practice your skills related to observation and memory skills.
  • Secure Communication: The App includes real-time chat functionality, powered by Twilio, that facilitates secure, direct communication between you and App administrators.
  • Proactive Engagement: TThe Service delivers a system of reminders, push notifications and general announcements to help you use the App effectively, stay informed about events you have registered for or shown interest in, and, where permitted by law, receive information about similar future events and services, as described in our Privacy Policy.
In addition, the App provides an event and conference module (the „Event Module”). The Event Module allows registered users to: 
● browse information about conferences and events, including detailed agendas, session descriptions and locations; 
● view profiles and biographies of speakers, organizers, sponsors, exhibitors and other participants, including their professional roles, affiliations and business contact details; 
● access event-related materials such as presentations, documents, audio and video recordings, transcripts and photo galleries; and 
● view information about past and future events, including archived agendas and materials from previous editions.
 
For the purposes of these Terms, „Participants” are users attending or interested in an event; „Speakers” are individuals presenting at an event; „Sponsors” and „Exhibitors” are organizations promoting their products or services at an event; and „Organizers” are entities responsible for organizing and managing the event.
 
Innovation Lab provides the App as a technical platform. Unless expressly stated otherwise, Innovation Lab is not the legal organizer of the events displayed in the App. The responsibility for the organization and execution of each event lies with the respective Organizer.

3. User Accounts and Responsibilities

Account Registration and Security

To create an account, you must provide a valid email address and create a secure password. For enhanced security, SMS verification may be used during registration or login. You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any verification codes. You are fully responsible for all activities that occur under your account.

Lawful and Appropriate Use

You agree to use the App only for its intended purposes as described in Section 2 and in full compliance with all applicable local, national, and international laws and regulations. You are strictly prohibited from:

  • Submitting false or misleading information or information belonging to another person without their explicit consent.
  • Attempting to gain unauthorized access to our systems, reverse-engineering the App, or using the Service to transmit malicious code or unlawful content.
  • Interfering with the security-related features of the Service, including those that manage authentication tokens or secure communication channels.
You must not submit personal data of third parties (such as colleagues, employees, speakers, or other representatives) to the App unless you have a valid legal basis to do so under applicable data protection laws (e.g. consent or legitimate interest) and have informed them about such processing where required.
 
You agree not to use contact details and other information about other users, speakers, sponsors, exhibitors or organizers obtained through the App: 
● to send unsolicited bulk communications or marketing (spam); 
● to create or enrich external marketing databases; or 
● in any manner that is harassing, abusive or otherwise unlawful.
 
Any networking features and visibility of your profile within the Event Module are intended solely for establishing individual professional contacts related to the events presented in the App. You remain solely responsible for any communications and relationships you establish with other users outside the App.
 
By creating an account, you represent that you are at least 18 years old (or the age of legal majority in your jurisdiction) or that you have obtained verifiable consent from a parent or legal guardian where required by applicable law.

Accuracy of Information

You represent and warrant that all information you provide to the Service, including personal profile data is accurate, current and complete. You acknowledge that the functionality and effectiveness of the Service are contingent upon the accuracy of this information.

4. Data Handling and Privacy

The collection, use, storage, and protection of your personal data are governed by the Innovation Lab’s Privacy Policy. We strongly encourage you to read the Privacy Policy in its entirety to understand your rights and our commitments regarding your personal information under the General Data Protection Regulation (GDPR) and other applicable laws.

In particular, the Event Module may involve processing of professional profile information (such as job title, company, professional biography, business contact details), images and recordings from events, and information about your participation in past and future events as described in our Privacy Policy. The visibility of certain elements of your profile to other users may depend on the settings available in the App and the configuration chosen by the relevant Organizer.

For certain events, the relevant Organizer may act as an independent or joint controller of your personal data together with Innovation Lab, as described in our Privacy Policy and any event-specific privacy notices.

5. Intellectual Property

The Service, including all of its software, code, interfaces, text, graphics, logos, and data models, is the exclusive property of Innovation Lab Sp. z o.o. and its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the App for your personal, non-commercial use only, strictly in accordance with these Terms of Service. This license does not grant you the right to, and you agree not to: (a) reproduce, distribute, publicly display, or publicly perform the Service; (b) make modifications to the Service; or (c) interfere with or circumvent any feature of the Service, including any security or access control mechanism.

All trademarks, logos and trade names displayed in the App in relation to events, sponsors, exhibitors, speakers or other third parties are the property of their respective owners. Nothing in these Terms grants you any rights in such trademarks, logos or trade names.

6. USER CONTENT AND EVENT MANAGEMENT

User Content 

Certain features of the App allow you or your organization to submit, upload or otherwise make available content, including but not limited to biographies, photos, logos, presentation materials, session descriptions, messages and other information („User Content”). You retain all rights you may hold in your User Content, subject to the rights granted to Innovation Lab in these Terms. 

License 

Grant By submitting User Content to the App, you grant Innovation Lab a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, adapt, display and distribute such User Content within the App and related services, for the purpose of providing, operating, improving and archiving the Service and the events presented in the App. 

Warranties 

You represent and warrant that: (a) you have all rights, licenses and permissions necessary to submit the User Content and grant the above license; and (b) the User Content does not infringe any third-party intellectual property rights, privacy rights or other rights, and does not violate any applicable laws. 

Event Materials and Recordings 

Event-related materials (such as slides, documents, audio/video recordings, transcripts and photos) may be provided by Organizers, Speakers, Sponsors or other third parties. Innovation Lab is not responsible for the accuracy, completeness or legality of such materials and does not endorse any views expressed therein. Any use of such materials outside the App is at your own risk and may be subject to additional terms of the respective rights holders.

Notice and Takedown 

If you believe that any content in the App infringes your rights or is otherwise unlawful, you may notify us at parsanki@innovationlab.pl with sufficient details. We will review such notices and may remove or restrict access to the content at our discretion, without prejudice to any other rights we may have.

 

7. Account Suspension and Termination

Innovation Lab reserves the right to suspend or terminate your account and access to the Service, at our sole discretion and without prior notice, for reasons that include, but are not limited to:

  • A breach or violation of these Terms of Service.
  • Engaging in activity that is unlawful, fraudulent, or malicious.
  • Posing a security risk to the Service or to other users.
We may suspend or terminate your account in particular if you: 
● misuse contact details or other information obtained through the App for unsolicited marketing or harassment; 
● upload or distribute content that infringes intellectual property or privacy rights of others; or 
● repeatedly violate event-specific rules or codes of conduct communicated by Organizers.
 
Upon termination, your right to use the Service will cease immediately. We will revoke your access credentials and take measures to prevent your devices from receiving further notifications from the Service.

Termination of your account does not automatically remove event materials, agendas, recordings or other content previously associated with events you participated in, to the extent such materials must be retained for archival, contractual or legal reasons. Where possible, personal data will be minimized or anonymized in accordance with our Privacy Policy.

8. Limitation of Liability

The Service is provided on an „as is” and „as available” basis, without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, Innovation Lab Sp. z o.o., its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, opportunities, reputation, profits, or revenues, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any errors, inaccuracies, or omissions in any content or information provided through the Service, including any output from AI-assisted features; (iii) any conduct or content of any third party on the Service; or (iv) unauthorized access, use, or alteration of your data.

The Service may integrate with or rely on third-party services, such as communication and cloud hosting providers. We do not control and are not responsible for the performance, reliability, or security of any third-party services.

Without limiting the foregoing, Innovation Lab shall not be liable for: 

● any changes to the agenda, schedule, speakers, location or format of any event; 

● the cancellation or postponement of any event by the Organizer; 

● any statements, recommendations or opinions expressed by speakers, sponsors, exhibitors or other third parties, or any decisions you make based on such information; or 

● any issues related to travel, accommodation or other logistical arrangements for events, which remain your sole responsibility and/or the responsibility of the Organizer or third-party providers.

9. Modifications to the Terms

Innovation Lab reserves the right to modify these Terms at any time. If we make changes that are material, we will provide you with reasonable notice of such changes, for example, by posting a notification within the App or by other electronic means. Your continued use of the App after we have communicated any such changes will constitute your acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms will be brought exclusively in the competent courts located in Warsaw, Poland.

If you are a consumer residing in the European Union, you may also benefit from mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under such mandatory provisions.

11. EVENT RULES AND THIRD-PARTY TERMS

Participation in specific events presented in the App may be subject to additional terms and conditions, codes of conduct or privacy notices issued by the relevant Organizer or third parties (e.g. ticketing or streaming providers). In case of any conflict between such event-specific terms and these Terms, the event-specific terms shall prevail with respect to your participation in that event. You are responsible for reviewing and complying with any such additional terms.
