TERMS OF SERVICE

This document constitutes a legally binding agreement between you (the „User,” „you,” or „your”) and Innovation Lab Sp. z o.o. („Innovation Lab,” „we,” „us,” or „our”) concerning your use of the Innovation Lab’s PARSANKI Mobile Application (the „App” or „Service”).

By creating an account, logging in, or using the Service, you agree to be legally bound by these Terms of Service and our accompanying Privacy Policy.

1. Acceptance of Terms

The act of registering for an account, logging into the App, or using any of its features constitutes your full acceptance of these Terms of Service and the accompanying Privacy Policy. The account creation process explicitly requires your agreement to these terms, as captured by the termsAccepted parameter submitted during registration.

2. Description of the Service

The Innovation Lab’s PARSANKI Mobile Application is a comprehensive mobile tool designed to improve cognitive abilities od users. The Service is intended for use by players, in single or multiplayer mode, to practice and enhance observation skills and memory.

The core functions of the Service include:

  • Memory Improvement Games: You can practice your skills related to observation and memory skills.
  • Secure Communication: The App includes real-time chat functionality, powered by Twilio, that facilitates secure, direct communication between you and App administrators.
  • Proactive Engagement: The Service delivers a system of reminders, push notifications and general announcements to help your habits, and remain informed about important updates.

3. User Accounts and Responsibilities

Account Registration and Security

To create an account, you must provide a valid email address and create a secure password. For enhanced security, SMS verification may be used during registration or login. You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any verification codes. You are fully responsible for all activities that occur under your account.

Lawful and Appropriate Use

You agree to use the App only for its intended purposes as described in Section 2 and in full compliance with all applicable local, national, and international laws and regulations. You are strictly prohibited from:

  • Submitting false or misleading information or information belonging to another person without their explicit consent.
  • Attempting to gain unauthorized access to our systems, reverse-engineering the App, or using the Service to transmit malicious code or unlawful content.
  • Interfering with the security-related features of the Service, including those that manage authentication tokens or secure communication channels.

Accuracy of Information

You represent and warrant that all information you provide to the Service, including personal profile data is accurate, current and complete. You acknowledge that the functionality and effectiveness of the Service are contingent upon the accuracy of this information.

4. Data Handling and Privacy

The collection, use, storage, and protection of your personal data are governed by the Innovation Lab’s Privacy Policy. We strongly encourage you to read the Privacy Policy in its entirety to understand your rights and our commitments regarding your personal information under the General Data Protection Regulation (GDPR) and other applicable laws.

5. Intellectual Property

The Service, including all of its software, code, interfaces, text, graphics, logos, and data models, is the exclusive property of Innovation Lab Sp. z o.o. and its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the App for your personal, non-commercial use only, strictly in accordance with these Terms of Service. This license does not grant you the right to, and you agree not to: (a) reproduce, distribute, publicly display, or publicly perform the Service; (b) make modifications to the Service; or (c) interfere with or circumvent any feature of the Service, including any security or access control mechanism.

6. Account Suspension and Termination

Innovation Lab reserves the right to suspend or terminate your account and access to the Service, at our sole discretion and without prior notice, for reasons that include, but are not limited to:

  • A breach or violation of these Terms of Service.
  • Engaging in activity that is unlawful, fraudulent, or malicious.
  • Posing a security risk to the Service or to other users.

Upon termination, your right to use the Service will cease immediately. We will revoke your access credentials and take measures to prevent your devices from receiving further notifications from the Service.

7. Limitation of Liability

The Service is provided on an „as is” and „as available” basis, without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, Innovation Lab Sp. z o.o., its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, opportunities, reputation, profits, or revenues, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any errors, inaccuracies, or omissions in any content or information provided through the Service, including any output from AI-assisted features; (iii) any conduct or content of any third party on the Service; or (iv) unauthorized access, use, or alteration of your data.

The Service may integrate with or rely on third-party services, such as communication and cloud hosting providers. We do not control and are not responsible for the performance, reliability, or security of any third-party services.

8. Modifications to the Terms

Innovation Lab reserves the right to modify these Terms at any time. If we make changes that are material, we will provide you with reasonable notice of such changes, for example, by posting a notification within the App or by other electronic means. Your continued use of the App after we have communicated any such changes will constitute your acceptance of the new Terms.

9. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms will be brought exclusively in the competent courts located in Warsaw, Poland.
